Ahwatukee RST is an age-restricted (50+ years) single-family home community in Phoenix, AZ, governed by two entities: the Ahwatukee Board of Management (ABM) for common areas and the Ahwatukee Recreation Center (ARC) for recreational facilities. All lots are subject to this declaration, which runs with the land and binds all owners, tenants, and occupants.
- Age restriction (50+): No lot may be owned by anyone under 50, nor occupied as a residence where the husband or wife or principal occupant is under 50. No one under 18 may occupy a lot. Membership in the ARC recreation center is also limited to owners 50+ and their spouses.
- What you own & maintain: You own your lot and single-family dwelling (minimum 900 sq ft living area). You must maintain your property, including landscaping the front yard within 2 years of purchase. The ABM maintains common areas; ARC operates recreational facilities.
- Leasing & rentals: All leases must be in writing and include a clause that the tenant agrees to comply with the declaration, ABM/ARC rules, and that any violation is a lease default. The owner remains liable for assessments and damages if the tenant fails to comply.
- Pets: No livestock or poultry. Up to 3 dogs and/or cats combined are allowed, provided they are confined to the owner's lot or on a leash, not kept for commercial purposes, and not in unreasonable numbers. The ABM may adopt additional pet rules.
- Parking & vehicles: No trailers, campers, motorhomes, boats, planes, or off-road vehicles may remain on a lot except for loading/unloading. Parking is allowed only in the garage, driveway, or street. Golf carts and regular passenger cars (including motorcycles and pickup trucks) are permitted.
- Architectural & appearance restrictions: All buildings must be constructed of brick, cement block, or substantial materials. Setbacks: front at least 20 ft, side at least 5 ft (10 ft if adjacent to street), rear at least 25 ft from golf course boundary. Fences/walls cannot exceed 6 ft in height; those bordering a golf course have additional height and material restrictions. Clotheslines, storage piles, and service yards must be screened. No outdoor antennas or satellite dishes (subject to FCC rules).
- Assessments & fees: ABM annual assessments start at $35/lot, with yearly increases up to 5% without membership vote. ARC annual assessments start at $60 per owner (and $60 for spouse), with amounts determined by ARC board. Special assessments for capital improvements require 2/3 vote. Unpaid assessments bear 10% interest and become a lien on the property.
