What Summer Lane's governing documents say
Summer Lane is a single-family residential subdivision in Phoenix governed by a homeowners association. All lot owners automatically become association members upon purchase and must pay annual assessments for common area maintenance. The builder retains temporary voting control (3 votes per lot vs. owners' 1 vote each) for up to 6 years or until owner votes exceed builder votes.
- Voting & builder control: Lot owners (Class A members) have 1 vote per lot; the builder (Class B) has 3 votes per lot. The builder's Class B status converts to Class A (1 vote per lot) when: 4 months after owners' votes equal or exceed the builder's votes, OR 6 years after the first lot sells, OR the builder voluntarily relinquishes it.
- Annual assessments: Annual assessment was capped at $229 per lot through December 31, 1994; after that, the board sets assessments but increases are limited to the greater of 10% or the Consumer Price Index. Late payments incur a $50 one-time charge plus 18% annual interest; non-payment can lead to foreclosure.
- What you maintain vs. the association: You maintain your dwelling unit, yard (lawns, plants, irrigation, trees, shrubs), and all utilities/equipment (AC, heating, appliances, plumbing, electrical). The association maintains common area tracts: drainage areas, public sidewalks, and designated landscape tracts.
- Landscaping requirements: Your public yard (visible from neighboring properties or streets) must be landscaped within 120 days of purchase unless the builder completed it. All landscaping plans require architectural committee approval before installation.
- Architectural review: Modifications, improvements, and changes to your property require approval from the architectural committee, which has sole judgment over whether changes meet approval standards.
- Use restrictions: Commercial and business use prohibited. The document prohibits or restricts: hazardous materials, outdoor burning, fuel tanks, drilling and mining, subdivision of lots, commercial/recreational vehicles, and unapproved signs. Animals, roof-mounted equipment, and vehicle repairs are restricted (specific rules in full document).
- Suspension of rights: If you fail to pay assessments with interest and late fees, or violate rules without curing them, the association can suspend your voting rights and access to common areas until resolved.
