Bethany Heights Four is a single-family residential subdivision in Phoenix, AZ, governed by recorded restrictive covenants that run with the land. These rules apply to all lot owners and regulate what can be built, how property is used, and the appearance of homes and yards.
- Building & lot use: Only one single-family residence and a private garage or carport for up to two cars may be built per lot. The ground floor area must be at least 800 sq ft for a one-story home or 600 sq ft for a multi-story home (exclusive of open porches, pergolas, or garage). No building may exceed 30 feet or two stories. A maximum of 40% of the lot area may be covered by buildings.
- Setbacks & fences: Front setbacks: at least 20 feet from the front property line, though a front porch, attached garage, or carport may project up to 7 feet. Side setbacks: at least 7 feet on each side (except open-sided carports may be as close as 3 feet if certain conditions are met). Fences: no solid wall or fence over 3 feet high within 20 feet of the front street line; side and rear fences up to 6 feet are allowed. Hedges over 3 feet may not be within 20 feet of the front property line.
- Architectural review: No building, fence, or wall may be constructed or altered without prior approval of the Architectural Control Committee. The Committee must approve plans as to quality of workmanship, materials, harmony of design, and location. If the Committee fails to act within 30 days of submission, approval is deemed given unless a suit is filed before construction is completed.
- Prohibited uses: No commercial animal husbandry, livestock, or poultry. No abandoned or inoperable vehicles visible from other lots or streets. No noxious or offensive activities. No temporary structures (trailers, tents, shacks) used as residences. No commercial signs except one small sign advertising the property for sale or rent. No oil drilling, mining, or similar operations.
- Duration & amendments: These covenants run with the land for 35 years from the date recorded (October 9, 1973), and automatically renew for successive 10-year periods unless a majority of lot owners vote to change or terminate them.
