The Residences at Belmonte is a planned community of detached single-family homes in Chandler, AZ, governed by a homeowners association (HOA). All owners automatically become members of the association and must comply with the covenants and restrictions that run with the land. The document sets rules for residential use, property maintenance, architectural changes, assessments, and leasing.
- Residential use & home businesses: Each lot must be used only for single-family residential purposes. Limited home-based businesses are allowed if conducted entirely inside the home, with no external signs of business activity, no employee non-residents, and no customer traffic.
- Leasing & rentals: Owners may lease their entire lot and residence, but leases must be in writing for an initial term of at least six months. Owners must provide the association with tenant names, lease dates, and emergency contact info at least 10 days before occupancy.
- Pets: Only common household pets (dogs, cats, etc.) are allowed, in types and numbers approved by the architectural committee. Pets must be kept on a leash or within a fenced yard. No animals for commercial purposes.
- Parking & vehicles: Parking on front yards and driveways is limited; no vehicles longer than 18.5 feet, higher than 6.25 feet, or wider than 7.0 feet may be stored on lots unless screened from view. Commercial vehicles are prohibited if visible from neighboring property. Inoperable vehicles are banned, and the association may tow violators at owner expense.
- Architectural control & exterior changes: All exterior improvements, including landscaping, fences, solar panels, antennas, and color changes, require prior written approval from the architectural committee. Design guidelines are established by the declarant. Committee decisions are final but appealable to the board.
- Assessments & fees: The association levies annual assessments, special assessments (with 2/3 member vote), and benefited assessments. A working capital fee equal to one-sixth of the annual assessment (or as set by the board) is due from each new owner. Late charges of 10% or maximum under Arizona law apply.
- Party walls: Walls built on lot lines are considered party walls. Each owner maintains the exterior surface facing their lot. Repair costs are shared equally unless damage is caused by one owner, who must then pay all costs and indemnify the neighbor.
