Calliandra Estates is a single-family home HOA in Phoenix, AZ. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners, residents, and their guests. It sets out the rules for living in the community, covering use of property, maintenance responsibilities, and association powers.
- Residential use & home business: All residences must be used only for residential purposes. A home business is allowed if it is not visible or audible from outside, does not generate customer traffic, and is conducted only by residents without non-resident employees. Model homes and leasing are not considered businesses.
- Leasing & rentals: Leases must be in writing, for an initial term of at least one month, and must state that the lease is subject to the governing documents. The owner must provide the association with tenant info and vehicle details at least 10 days before the lease starts. Owners remain liable for tenant violations.
- Pets: A reasonable number of dogs, cats, and similar household pets (not for commercial purposes) are allowed. The board determines what is reasonable. Dogs must be leashed (max 6 feet) when off the lot, and owners must clean up feces. No pets may be left unattended outdoors, and outdoor animal structures are prohibited.
- Vehicles & parking: No mobile homes, trailers, boats, or similar equipment may be parked visible from neighboring property. Commercial vehicles over 8 feet tall or 24 feet long cannot be parked where visible, except temporarily. No vehicle repairs visible from neighboring property. Garage doors must be kept closed except for ingress/egress.
- Architectural review: All exterior modifications, including antennas, satellite dishes, signs, exterior lights, window coverings, playground equipment, and basketball goals, require prior written approval from the Design Review Committee (or the Board if no committee). Design Guidelines apply. Temporary structures during construction must be removed within 12 months.
- Assessments: The association levies annual assessments, special assessments (by board vote), and optional maintenance assessments on each lot. Nonpayment creates a lien and can lead to suspension of common area use (except streets) after 15 days delinquency. A working capital fee may also be charged upon sale or transfer.
- Signs: No signs may be placed on a lot that are visible from neighboring property without prior approval, except signs the association cannot prohibit under Arizona law. For-sale or open-house signs require approval if visible from neighboring property.
- Gated entry & security: The declarant intends to construct gated entries on private streets, but does not guarantee security or safety. Owners assume risk of delays for emergency vehicles. The association is not liable for damages from gate operation or failure.
