Casa De Cuatros North Condominiums is a 52-unit condominium community in Phoenix, AZ — you own your individual apartment unit and an undivided 1/52 interest in the common elements. This document is the original 1973 Declaration of Covenants, Conditions and Restrictions that governs the community and binds all unit owners, their tenants, and guests.
- What you own & maintain: You own the interior surfaces of your unit and are responsible for its maintenance, repair, and replacement, except portions maintained by the association (perimeter walls, floors, ceilings, load-bearing walls, roof, exterior fixtures, and utility conduits serving more than one unit). You must also maintain your patio area and promptly report defects in association-maintained areas.
- Leasing & rentals: Entire apartments may be rented only to a single family (plus servants and guests). No rooms may be rented separately, and no transient tenants are allowed. The document does not state a minimum lease term, but the lease must be for the entire apartment.
- Pets: Household pets (dogs, cats, or other similar pets) are allowed, but they may not be kept, bred, or maintained for commercial purposes. No animals, livestock, or poultry of any kind are otherwise permitted.
- Parking & vehicles: Boats and campers mounted on trucks must be kept covered and parked only in designated parking spaces or garages. Trailers and trucks in excess of 3/4 ton are completely prohibited from parking or being kept anywhere within the property, including garages and parking spaces.
- Use of property: Each apartment must be occupied only as a residence by a single family. No business activities of any kind are allowed. No nuisances, immoral or unlawful uses, or activities that interfere with other residents are permitted. No clotheslines or outside visible antennas may be installed.
- Assessments & fees: Each unit pays 1/52 of the annual common expenses, which include maintenance, repairs, insurance premiums, reserve funds, and other costs determined by the Board of Directors. Assessments are due in monthly installments in advance. Late payments incur 8% annual interest and may become a lien on the unit, enforceable by foreclosure. Late charges may also be added.
- Insurance: The association carries master casualty and liability insurance on the buildings and common elements. Premiums are a common expense. Each owner is responsible for insuring their own personal property and obtaining personal liability coverage. In case of damage, insurance proceeds are held by the association for rebuilding; any shortfall may be specially assessed against affected units or all units depending on the damage.
- Architectural & exterior changes: No alterations to portions of the unit maintained by the association (including exterior walls, roof, and patio fences) may be made without prior written approval from all other unit owners and the board of directors. No painting or decorating of any exterior portion is allowed. Planting or structures in patios must not harm the overall design.
