What Casitas Serenas Condominiums's governing documents say
Casitas Serenas is a condominium in Phoenix, AZ, where you own your individual unit while the association maintains the shared building structure and grounds, funded by per-unit assessments. This is the founding declaration (1999) that establishes the community's ownership structure, governance, and core operating rules.
- What you own & maintain: You own your unit's interior finishes and layout (interior walls, flooring, ceilings); the association maintains the building structure, roof, common areas, and utilities. You are responsible for maintaining any patio or balcony allocated to your unit.
- Assessments & voting: Common expenses are assessed equally across all units (each unit currently has 1/8 of the common expense share). You have one vote per unit in association decisions. The board adopts an annual budget 60 days before each fiscal year.
- Leasing restrictions: You must lease your entire unit (no partial leases or short-term rentals), with the lease in writing and subject to the condominium rules. You must notify the association of lease start/end dates and provide occupants' names.
- Pets: Maximum one pet per unit, not exceeding 20 pounds. Pets must be inoculated and registered with the association. Dogs must be kept on a leash of 6 feet or less when outside your unit, and owners must immediately clean up any messes on common property.
- Alterations & architectural review: You can make nonstructural changes inside your unit without approval (though you're liable for any damage to other units). Structural work and anything visible from the building's exterior requires prior written Architectural Committee approval and, for structural work, certification from a licensed Arizona architect or engineer.
- Parking & vehicles: Vehicles must be parked in designated spaces only. No commercial trucks or vans over 3/4 ton capacity are allowed without board approval. No vehicle servicing, construction, or inoperable cars are permitted if visible from neighboring property. The association can tow violations at the owner's expense.
- Residential use only: Units are for single-family residential use only; no business operations or gainful occupations are permitted (though you may conduct personal business calls, maintain professional records, or keep a personal library from home). No home-based services, commercial activities, or manufacturing.
- External restrictions: The property is also subject to a 1971 Fountain Hills Declaration and its separate architectural rules. If any rules conflict, the more restrictive requirement governs both.
