Corte Madera is a planned community in Phoenix, AZ, composed of 45 lots and common areas, governed by a homeowners' association (HOA). The lots are subject to party-wall agreements, meaning many homes share walls (typical of townhomes or attached dwellings). This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that apply to all lot owners.
- What you own & maintain: You own your lot; the association owns and maintains the common areas. Party walls between lots are jointly maintained by the owners who use them, with costs shared proportionally.
- Assessments & fees: The initial maximum annual assessment was $360 per lot. Annual assessments can increase up to 3% per year without a vote; larger increases or special assessments for capital improvements require approval by two-thirds of each voting class.
- Voting & membership: Every lot owner is a member of the association and gets one vote per lot. The developer (Declarant) had 3 votes per lot initially, with that enhanced voting power ending by September 15, 1977 or when Class A votes equal Class B votes.
- Architectural review: No structures, exterior additions, or alterations may be built without prior written approval from the board or an architectural committee. If no decision is made within 30 days, approval is deemed given. Full or partial walls that enclose carports are prohibited.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared by the owners who use the wall. If destroyed, any user may restore it, and others who later use it must contribute. Disputes go to arbitration.
- Enforcement & amendments: Association or any owner can enforce the rules. Failure to enforce does not waive rights. Amendments during the first 20 years require 90% of lot owners' approval; thereafter, 75% approval. Amendments must be recorded. The declaration runs with the land for 20 years, auto-renewing for 10-year periods.
