Estadas De Los Naranjas is a planned community of single-family detached homes in Phoenix, AZ. Each lot owner holds a 1/8 undivided interest in common areas managed by an HOA. The association maintains landscaping, a tennis court, and driveways on commonly-owned lands, pays property taxes on those tracts, and carries liability and property insurance.
- What you own & maintain: You own your lot and the dwelling on it. The HOA maintains the common areas (landscaping, tennis court, driveways) and pays taxes and insurance on those areas. You must maintain your own premises consistent with the community's exclusive nature.
- Assessments & fees: All owners pay a uniform monthly assessment, which may be increased by the HOA. Special assessments require approval of 75% of owners. Unpaid assessments become a lien on the property and may be foreclosed after 90 days, subject to Arizona law.
- Right of entry & maintenance: If you fail to maintain your property, the HOA may enter and perform necessary repairs, charging the cost to you as a lien.
- Financing protections: Assessment liens are subordinate to first mortgages. A foreclosure sale of a first mortgage extinguishes assessment liens that became due after the mortgage was recorded.
