What Desert Shores's governing documents say
This is an amendment to the governing documents of the Desert Shores Homeowners Association in Phoenix, AZ. It adds rules specifically for owners who rent out their units, establishing deposit requirements, documentation obligations, and tenant compliance procedures. It does not replace the full declaration or other rules.
- Leasing & rentals: Owners renting a unit must provide the association with a signed copy of a Desert Shores approved lease agreement. A $300 deposit is required for leases over 6 months; for leases under 6 months, the deposit is $100. The deposit covers administrative costs and is refunded within 45 days of lease end, minus any violation fees.
- Owner obligations: Owners must provide renters with a copy of the CC&Rs and rules/regulations (Resident's Handbook) and obtain a signed acknowledgment, which must be filed with the association. Failure to do so results in a $100 fine per month the violation continues. Lease agreements must include the renter's full name, social security number, and emergency contact, plus a signed crime-free lease addendum.
- Tenant violations: If a tenant violates the CC&Rs or rules, the association notifies the owner, who has 30 days to remedy. If not remedied, the owner must promptly start eviction proceedings and cannot compromise or settle without the association's written consent.
- What this document doesn't cover: This is a partial amendment only adding leasing-related rules. It does not cover other typical HOA topics such as architectural review, parking, pets, assessments, or maintenance responsibilities.
