Eagletail Ranches is a rural residential subdivision in Phoenix, AZ, governed by a Declaration of Deed Restrictions that run with the land. These restrictions apply to all property owners and aim to maintain a rural residential character, allowing farming and livestock under specific limits.
- Allowed uses: Properties are limited to residential use and normal accessory activities, including house pets. Farming and agricultural uses are permitted as long as they are not a nuisance—examples include pasturing horses, cattle, and ostriches, and growing field crops or trees. Commercial operations like hog farms and chicken hatcheries are prohibited.
- Livestock limits: On parcels of 10 acres or more, the combined livestock total is limited to no more than one animal per acre. Smaller parcels have no specific per-acre limit, but nuisance restrictions apply.
- Building requirements: All buildings must be completed within 12 months of starting construction. - Property maintenance: Properties must be maintained in a sanitary manner. No accumulation of rubbish, junk, salvage, or debris that is unsightly, offensive, or detrimental to neighbors. Reasonable landscaping and weed control are required on each parcel.
- Utilities: All public and private utilities must be installed underground.
- Duration and changes: The restrictions are binding for 20 years from recording, automatically renewing for successive 10-year periods. A majority of owners (voting per acre) can vote to change the covenants at any time.
- Association formation (future possibility): At any time during the initial 20-year period, a majority of owners (voting per acre) may form an association to enforce restrictions and manage road maintenance, community tree watering, garbage pit maintenance, and enforcement—funded by voluntary contributions.
- Who enforces: Any individual owner has standing to sue in court to enforce any provision of these restrictions.
