White Owl Ranch is a single-family residential subdivision near Tonopah, Arizona, governed by a Declaration of Covenants, Conditions and Restrictions. The parcels are intended for residential, recreational, or agricultural use. There is no mandatory homeowners association; covenants are enforced by individual owners. The community allows horses and other animals subject to zoning, and owners may lease their entire parcel for terms of at least five years.
- Allowed uses: Parcels may be used only for single-family residential, recreational, or agricultural purposes. No business, trade, or public invitation is allowed on any parcel. Entire parcels (with improvements) may be leased, but no portion may be rented separately.
- Animals: A reasonable number of animals (including horses) may be kept, subject to applicable zoning. Animals may not create excessive noise or become a nuisance, and must not roam onto other parcels. Animals are permitted only after a dwelling or fencing is complete or the owner is present.
- Temporary occupancy & structures: Trailers, garages, or barns may be used as temporary residences only during construction of a single-family home, and only with a county permit. Temporary buildings must be removed after construction is complete. Detached garages, barns, and stables are allowed as long as they comply with the declaration.
- Property maintenance & nuisances: Owners must keep buildings and landscaping in good repair, free from weeds, debris, and unsightly accumulations. No noxious odors, excessive noise, or activities that disturb neighbors are permitted. Trash must be in covered containers; manure piles must not create odors.
- Leasing & rentals: An owner may lease the entire parcel with its improvements, but only for a term of at least five years (including options). The tenant must agree in writing to abide by the declaration. Leases of less than five years are not allowed.
- Enforcement & amendments: Any owner may enforce the covenants through legal action, and the prevailing party may recover attorney's fees. Amendments require the signature of owners of more than 50% of the parcels, plus the declarant if it still owns any parcels. The declaration runs for 20 years from recording (1998) and automatically renews every 10 years.
- General restrictions: No mineral exploration, drilling for oil or gas, or removal of gravel/earth is allowed except for domestic water wells. No machinery or equipment other than that usual for agricultural or residential maintenance is permitted. Owners are responsible for their guests and tenants.
