What Eagle Tail Farms's governing documents say
Eagle Tail Farms is a single-family residential subdivision in Tonopah, Arizona, governed by a 1972 Declaration of Restrictions that run with the land. These are deed restrictions binding all owners—not an HOA with dues or a board. The rules cover land use, building requirements, and basic maintenance standards; there is no association enforcing them beyond court action.
- Allowed uses: Property is restricted to single-family or multi-family dwelling use. No business is permitted except as necessary for operating apartments, rental units, or farming.
- Building & construction: All buildings must be completed within 12 months of starting construction. Setbacks: at least 40 feet from front property line, 10 feet from side, and 20 feet from rear. No buildings, structures, fences, or shrubbery may be placed on recorded easements.
- Residential structures: No shed, tent, or similar structure may be used as a residence.
- Sanitation & plumbing: All plumbing (toilets, bathing, kitchen) must be modern inside type, connected to a septic tank with an adequate leach drainage line or an approved sewer line. No pit privy is allowed, even temporarily.
- Property maintenance: No rubbish, junk, salvage, or debris may accumulate to make a parcel unsanitary, unsightly, or detrimental to other parcels. Reasonable landscaping must be maintained on each occupied parcel.
- Pets & livestock: Hens, chickens, pets, and livestock are permitted. All penned areas must be well-maintained and comply with county/state health regulations. Commercial cattle feed yards are not allowed. Livestock must be kept in clean, sanitary facilities.
- Water & utilities: The property falls under the jurisdiction of Eagle Tail Farms Water Company, a private nonprofit cooperative. Owners must abide by fluoridation requirements and pay charges established by the utility for water and fluoridation services.
- Duration & amendment: These restrictions run for 20 years from May 22, 1972, and automatically renew for successive 10-year terms unless revoked or amended by a written instrument executed and acknowledged by two-thirds of the owners, recorded within 90 days before the expiration of the current term.
