Big Horn Farms is a single-family subdivision near Tonopah, AZ, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that run with the land. These rules are enforced by property owners themselves, not by a homeowners association.
- Permitted uses: Lots may be used for residential, recreational, or agricultural purposes only. 'Agricultural use' is limited to growing crops; raising livestock is specifically prohibited. No business or public-inviting activity is allowed, except leasing the entire improved lot.
- Animals & livestock: Owners may keep a reasonable number of animals on their lot, subject to zoning and nuisance rules (no excessive noise, roaming on other lots). However, the definition of 'Agricultural Use' explicitly bans raising livestock, creating an inconsistency – livestock manure is later mentioned as allowed under the Declaration.
- Leasing & rentals: An owner may lease their lot and improvements only as an entire unit (no partial rentals). Tenants must abide by the Declaration, and owners are responsible for compliance by tenants and guests.
- Temporary structures & occupancy: No trailer, tent, garage, barn, or temporary building may be used as a residence. A lot cannot be lived in until water-flushed toilets and interior bathrooms are installed. Construction storage structures must be removed after completion.
- Maintenance & upkeep: Owners must keep their buildings, landscaping, and other improvements in good repair. Lots must be free of weeds, debris, and unsightly accumulations. Trash must be in covered containers; incinerators are prohibited.
- Nuisances & noise: No nuisance, noxious activity, or offensive odor (including from manure) is allowed. Loud noises that disturb neighbors are prohibited. Any violation of law is also a violation of the Declaration.
- Enforcement & amendment: Any owner can enforce the covenants through legal action, and the prevailing party may recover attorney's fees. The Declaration runs for 20 years (from 1997), auto-renewing every 10 years. Amendments require approval of more than 50% of lot owners (plus Declarant's consent while it owns lots) and must be recorded.
