Indian Bend Villa Condominiums is a 16-unit condominium community in Phoenix, AZ. You own your unit individually and share ownership of common elements (including a pool, parking, and landscaping) as tenants in common. The association maintains exteriors, roofs, and common areas, while you maintain the interior of your unit. This document is the full declaration of covenants, conditions, and restrictions that binds all unit owners.
- What you own & maintain: You own the interior space of your unit (walls, floors, ceilings, windows, doors) and an undivided 1/16 interest in general common elements (building structure, land, pool, parking, etc.). The association maintains exteriors, roofs, and common areas; you maintain the interior, including fixtures, appliances, and termite control.
- Assessments & fees: Each unit pays an equal 1/16 share of annual assessments, initially capped at $480 per unit (subject to 5% annual increase by board vote). Special assessments for capital improvements require a 66% member vote. Delinquent assessments accrue 8% interest and become a lien on the unit, subordinate to first mortgages.
- Leasing & rentals: Units cannot be rented for transient or hotel purposes: minimum lease term is 30 days, and no customary hotel services (maid, linen, etc.) may be provided. Otherwise, owners may lease freely, subject to all governing documents.
