Mission Tierra is a single-family home subdivision in Phoenix, AZ, governed by a homeowners' association (HOA). You own your lot and house; the HOA maintains the common areas (Tract A and Tract B) and enforces the rules. Living here requires you to follow architectural, landscaping, parking, and pet restrictions, and pay annual or special assessments.
- What you own & maintain: You own your lot and the detached single-family house on it. The HOA owns and maintains the common areas (Tracts A & B). You must keep your lot landscaped and free of weeds, trash, and visible clotheslines.
- Architectural review: Any exterior change (construction, painting, fences, landscaping) requires prior written approval from the Architectural Control Committee (ACC). No reflective window coverings. All new buildings must be at least 900 sq ft livable area with a 2-car garage.
- Parking & vehicles: No RVs, boats, trailers, or non‑motorized vehicles may be stored where visible — they must be in a garage. Cars may park in the driveway for up to one week; after that they must be moved or garaged. Only passenger cars, vans, motorcycles, and small pickups (3/4 ton or less) are allowed outside.
- Animals & pets: Only common household pets are allowed (no livestock, poultry). Pets must be leashed outside your lot. No pet structures visible from neighboring property. The ACC can decide whether a pet or its number is reasonable.
- Landscaping & lot maintenance: Front yards must be fully landscaped within 6 months of buying a lot, with a plan approved by the ACC. Hedges in front cannot exceed 3 ft; side/rear fences up to 6 ft. Weeds and grass must be kept cut, and trash stored out of view.
- Assessments & fees: The annual assessment per lot initially cannot exceed $204. The board can increase it each year by up to the CPI change or 5% (whichever is greater). Special assessments may be levied for capital improvements or to fix violations. Unpaid assessments accrue 12% interest and become a lien.
- Use restrictions: Lots are for single‑family residential use only — no businesses, mobile homes, tents, or temporary structures. No noxious or offensive activities. Only new construction allowed (no moving houses onto a lot).
- Term & amendments: The restrictive covenants run with the land for 40 years from the original recording (1992), automatically renewing for 10‑year periods. Amendments require approval of at least 2/3 of lot owners.
