What Moon Valley Canyon's governing documents say
This document is an amendment to the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Moon Valley Canyon, a single-family subdivision in Phoenix, AZ. It modifies the obligations of the homeowners association and certain lot owners, and grants a specific easement. Because it is only an amendment, it does not contain the full rules of the community.
- Landscaping maintenance: The association is now responsible for maintaining the landscaping on the approximately 6-foot-wide angled berm adjacent to 12th Street, on Lots 52, 53, 71, 72, 73, 88, 89, and 90. Those lot owners are relieved of that obligation.
- Developer termination rights: If the developer sells Lots 98 through 119 and Common Areas H and I, and records an instrument of termination, the restrictions for those lots and common areas will end. The developer must then record an amended declaration.
- Easement for Lot 41: The owner of Lot 41 is granted a permanent easement over a portion of common area Tract A for ingress and egress only. The owner must get association approval before constructing any paving or driveway, and is responsible for all repairs and maintenance of the easement area. Failure to do so allows the association to enforce under the original restrictions.
- What this document doesn't cover: This amendment does not address typical HOA rules such as leasing restrictions, pet limits, assessment amounts, architectural review, or parking. For a complete picture of the community's rules, the original Declaration of Covenants, Conditions and Restrictions must be consulted.
