What Mountain Trails's governing documents say
Mountain Trails is a planned community of single-family homes in Phoenix, AZ, governed by this Declaration of Covenants, Conditions, and Restrictions (CC&Rs). This document sets the basic rules for living in the HOA, including permitted uses, parking, animals, and an architectural review process. Note: This is an excerpt of the full declaration – sections on leasing, assessments, and other details are not included here.
- Residential use & home businesses: Lots and homes must be used for single-family residential purposes only. Limited home businesses are allowed if not visible or audible from outside, comply with zoning, don't generate traffic, and are consistent with residential character. No manufacturing, industrial, or commercial uses are permitted.
- Animals: Only a reasonable number of common domestic pets (e.g., dogs, cats) are allowed, kept as pets and not for commercial purposes. No structure for pets may be visible from neighboring property. The Board decides if a pet is a nuisance or if the number is reasonable.
- Parking & vehicles: Vehicles must fit within factory dimensions (1 ton capacity, 96” height/width, 250” length) and be parked in a garage or on the paved driveway. No parking on landscaped areas, sidewalks, or overnight on streets. Larger vehicles (RVs, boats, campers, semi-trucks) may be stored only inside a garage or in designated areas permitted by the Board.
- Architectural review: All exterior improvements (structures, landscaping, solar panels, antennas, basketball goals, etc.) require prior written approval from the Design Review Committee. Design guidelines will be established. A review fee and construction deposit may be required.
- Gated entry & disclosures: The community may have gated entries, but the association and developer are not liable for security failures or delays. The property is near Phoenix Sky Harbor Airport (aircraft overflights and noise) and the Highline Canal (noise, dust, flooding risk). Owners assume these risks.
