What Sahuaro Vista Estates's governing documents say
This is a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for Sahuaro Vista Estates, a single-family home subdivision in Phoenix, AZ. It creates an HOA that binds all homeowners. The rules cover property use, maintenance, assessments, architectural controls, and vehicle restrictions.
- Use restrictions: Lots are for single-family residential use only. A 'Single Family' means up to 4 unrelated adults living together, or any number related by blood, marriage, or adoption. No commercial use is allowed.
- Architectural review: No exterior changes, additions, or new structures (including sheds, fences, etc.) may be built without prior written approval from the Architectural Committee. Plans are reviewed for harmony and compatibility; approval is deemed given if not acted upon within 30 days.
- Parking & vehicles: Commercial and recreational vehicles (e.g., boats, RVs, commercial trucks) are restricted. They may be parked only if screened from view or stored in a garage or approved side yard parking area. Personal vehicles (cars, pickup trucks under 1 ton) are generally allowed. No junk or repair operations.
- Assessments: The HOA levies annual and special assessments on all lots. Annual increases are limited to the greater of 10% or CPI change, with higher increases requiring a 2/3 member vote. Assessments are a lien on the lot and a personal obligation of the owner. Late fees and interest apply.
- Maintenance responsibilities: Owners maintain their own detached dwelling unit, yard, and landscaping. The HOA maintains common areas. If an owner fails to maintain, the HOA may step in and charge the owner. Fences along lot lines are jointly maintained by adjoining owners.
- Fences & walls: Fences require Architectural Committee approval. Unless otherwise approved, fences must be masonry block. Boundary fences are jointly maintained. Fences visible from the street or common area cannot be altered without approval.
