Mandalay at South Mountain is a standard single-family home HOA in Phoenix, AZ. This document is the full Declaration of Covenants, Conditions, and Restrictions that applies to all homeowners. It establishes rules for residential use, assessments, architectural control, parking, pets, and maintenance.
- Residential use & building standards: All lots must be used for single-family residential purposes only. Minimum livable square footage is 1,800 square feet (excluding garages, patios, etc.). Exterior materials must be stucco, masonry, or other approved materials.
- Assessments & fees: The maximum annual assessment initially is $385 per lot. Special assessments require approval by 2/3 of voting members. A transfer fee is due upon sale (amount set by Board). Unimproved lots pay 25% of annual assessment until building completion or six months after construction starts.
- Leasing & rentals: Leasing to a single family is allowed, but the owner must notify the Association of the lease term and lessee's name. For lease signs are subject to Board approval (except as allowed for real estate signs).
- Pets: Only a reasonable number of generally recognized house or yard pets allowed, kept as domestic pets, not for commercial purposes. No animal may create unreasonable noise or nuisance. Animal structures must not be visible from neighboring property.
- Parking & vehicles: On-street parking is discouraged; vehicles should be kept in garages, carports, or driveways. No mobile homes, travel trailers, boats, or inoperable vehicles may be parked on streets or common areas unless approved. Major vehicle repairs are prohibited on lots or streets.
- Architectural control: No exterior improvements (buildings, fences, color changes, landscaping, etc.) may be made without prior written approval from the Board. Basketball hoops are restricted in location and visibility.
- Maintenance responsibilities: The Association maintains common areas, including landscaping and walls adjacent to common areas. Each owner is responsible for maintaining their lot and improvements not maintained by the Association.
- Party walls: Walls on lot dividing lines are party walls shared equally by adjoining owners. Repair costs are shared based on frontage, unless damage is caused by one owner, who then bears the cost.
