Parcside III is a standard single-family home subdivision in Phoenix, AZ. These Covenants, Conditions & Restrictions (CC&Rs) apply to all lot owners and residents. They define what you can build, how you can use your property, and what the HOA expects of you.
- Residential use & lot rules: Each lot is limited to one single-family dwelling with an attached garage (max 3 cars), up to 2 stories or 30 feet tall, with a minimum of 900 square feet of living area. No business, commercial, religious, or institutional activities are allowed. Temporary structures and tents cannot be used as residences.
- Pets: Only dogs, cats, birds, or other small household pets are allowed. They cannot be kept, bred, or maintained for commercial purposes. Pets must not be allowed loose or unsupervised on any lot.
- Leasing & rentals: No portion of any lot may be rented except to a single person or a single family. This means no room-by-room rentals or renting to multiple unrelated parties.
- Parking & vehicles: Trucks, buses, trailers, boats, campers, and motorcycles must be parked only in garages, carports, or screened side/rear yards. Pickup trucks, passenger cars, and station wagons are exempt. No inoperable or abandoned vehicles are allowed, and major vehicle repairs visible from other lots or streets are prohibited.
- Architectural review: Any new construction, exterior additions, alterations, fences, walls, antennas, or landscaping visible from the street requires prior written approval from the Architectural Control Board. Plans must be submitted; the Board has 30 days to approve or reject them. Failure to reject within 30 days constitutes approval.
- Signs: Only one professionally prepared residence identification sign (max 1 sq ft) and one for-sale or for-rent sign (max 5 sq ft) are allowed per lot. All other signs are prohibited without Declarant approval.
- Fences & walls: Fences and walls must comply with Phoenix zoning. They cannot be placed in front of the dwelling without Board approval. Retaining walls under 3 feet may be approved. A minimum 6-foot fence is required on lot lines; cost-sharing rules apply for common boundary fences.
- Duration & amendments: These restrictions run with the land for 30 years from recording, automatically renewing for successive 10-year periods. Amendments require a majority vote of lot owners and written consent from all first mortgage holders. Until all lots are sold, the Declarant (builder) can amend or grant exceptions without owner vote.
