What The Townes at Paradise Valley Landings Condominium's governing documents say
The Townes at Paradise Valley Landings is a phased condominium community in Maricopa County, Arizona, developed by Pulte Home Corporation. You own your individual unit and share proportional ownership of common elements (building structure, parking, recreational facilities, utilities)—the association manages these shared areas. The community is planned for 274 total units across multiple phases; current ownership gives you automatic membership in the association, with voting rights tied to phased development.
- What you own & maintain: You own your unit's interior (finished walls, floors, ceilings); the association owns and maintains common elements including parking, building structure, utilities, and recreational facilities. Each unit comes with one assigned covered parking space, and you share non-exclusive use of all common recreational areas.
- Assessments & monthly fees: Annual assessments payable in 12 equal monthly installments; initial maximum is $900/unit/year. Increases capped at the greater of CPI or 10% annually (unless for utility/insurance costs); decreases capped at 20% below prior year. Late fee of $19 if unpaid within 10 days; 12% annual interest if unpaid after 30 days. Special assessments for capital improvements require a two-thirds member vote. Assessments create a lien on your unit.
- Membership & voting: Unit ownership automatically makes you an Association member. During development, Pulte holds Class B membership (multiple votes per unit) and can appoint board members; this ends 90 days after 75% of units are sold, OR 4 years after Pulte stops selling, OR 5 years from the first sale—whichever comes first. Other owners (Class A) get 1 vote per unit but cannot elect directors until Class B membership ends. Most decisions require 51% member approval; assessment increases and special assessments need a two-thirds vote.
- Phased development & property rights: The project is planned in up to 35 phases totaling 274 units (first phase: 24 units; most others: 6–8 units). Pulte retains development rights and can add phases, subdivide units, and modify common elements during the declarant control period. Partition of common elements is prohibited; your common-interest stake in shared facilities is permanent and inseparable from your unit.
- Architectural control & alterations: All alterations and improvements to your unit require prior written approval from the Architectural Control Committee and submission of plans. Unapproved changes are prohibited.
- Use restrictions: The declaration restricts leasing, animals, vehicles, signs, maintenance activities, garbage disposal, antennas, window coverings, and storage on units. The right to lease is addressed in the declaration, though specific lease-term minimums are not shown in this excerpt. Full details on each restriction are outlined in Article 8 of the declaration.
- Party walls & shared structures: The community addresses rights and duties regarding shared walls between adjacent units, including damage liability, negligence procedures, and approval for alterations affecting party walls.
- Insurance & damage procedures: The association carries master hazard insurance and liability insurance on common elements. If units are damaged or destroyed, reconstruction procedures are outlined; if the entire project is taken by eminent domain, termination procedures apply. Association insurance premiums are part of the assessment.
