Raintree Gardens (Units Four and Five) is a standard single-family home subdivision in Phoenix, AZ. This Declaration of Covenants, Conditions and Restrictions applies to lot owners and residents. It establishes rules for property use, maintenance, and assessments to protect property values.
- Property use & construction: Lots are limited to one detached single-family dwelling (max two stories) with a private garage for up to two cars. Minimum ground floor area: 1,200 sq ft for one-story, 1,600 sq ft for two-story (with at least 1,200 sq ft on ground floor). Setbacks: 20 ft front/rear, 10 ft side on corner lots, 4-6 ft on other sides. No temporary structures or trailers allowed.
- Business & nuisance activities: No business, professional, commercial, religious, or institutional use is permitted on any lot. No noxious or offensive activity, and no oil drilling, mining, or similar operations. Noisy equipment (lawn mowers, chain saws) cannot be operated on Sundays or national holidays.
- Pets and animals: Without board approval, a lot may keep up to two dogs, two cats, one dog and one cat, or two other small household pets. Up to two small caged birds are also allowed. No commercial breeding or keeping of other animals without written board consent. Pets must not be loose and walking is allowed only on designated areas.
- Parking & vehicles: Only passenger cars, station wagons, small trucks, motorcycles, small vans, boats, small trailers, and campers may be parked on a lot. No parking in the front yard (except driveway). Inoperable vehicles must be stored inside an enclosed garage. Visitors may park similar vehicles in allowed areas. No vehicle repair or storage of parts visible outside.
- Leasing & rentals: A lot may be rented only to a single person or a single family. No portion of a lot may be rented in a manner inconsistent with this restriction.
- Architectural review: No building, fence, wall, or other structure may be erected or altered on a lot until plans (including design, colors, materials, location) are approved in writing by the board or an architectural committee. Approval is deemed given if not acted on within 30 days after submission. Initial landscaping provided or approved by the board may not be changed without approval.
- Assessments & fees: Each lot owner must pay annual and special assessments. Initial maximum annual assessment is $12.00 per lot, adjustable annually by CPI or by a 2/3 vote of members. Special assessments for capital improvements require 2/3 vote of each class. Assessments are a lien on the property and may bear 10% annual interest if unpaid.
- Party walls & fencing: Fences built on dividing lines between lots are party walls. Repair and maintenance costs are shared equally among adjoining owners. Destruction by casualty is restored at shared cost unless caused by negligence of one owner. Any extension or alteration requires written consent of the adjoining owner.
