What Catavina's governing documents say
Catavina is a single-family home subdivision in Scottsdale, AZ, governed by a homeowners' association (HOA). This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that binds all lot owners. It establishes the HOA's powers, assessment obligations, use restrictions, and architectural controls.
- Assessments & fees: Annual assessments start at $720 per lot, adjustable by the Board up to CPI or 10% per year without a vote; larger increases need 2/3 member approval. Supplemental and special assessments also require a 2/3 vote. Assessments are a lien on the lot and personal obligation of the owner.
- Use restrictions: Lots are for single-family residential use only. No commercial activity is allowed. Dwelling units must be occupied by a single family (defined as persons related by blood/marriage/adoption, or up to three unrelated persons).
- Architectural control: All exterior improvements require prior approval by an Architectural Committee. The committee may adopt Architectural Rules covering design, materials, colors, and landscaping. No construction, alteration, or landscaping visible from neighboring property may proceed without approval.
- Maintenance responsibilities: The Association maintains common areas and certain amenities. Each owner is responsible for maintenance of their own lot, including the dwelling and all improvements. The Association has a right of entry for emergencies and to perform maintenance if an owner fails to do so.
- Membership & voting: Every lot owner is a member of the Association. Class A members (non-developer owners) get one vote per lot. The developer retains Class B membership with 25 votes per lot until a certain threshold is reached. Voting rights can be suspended for nonpayment of assessments or other defaults.
- Insurance: The Association is required to obtain property and liability insurance covering the common areas. Owners are responsible for insuring their own lots and improvements. The document also requires fidelity bonds for those handling Association funds.
