What Sombra De Montoya's governing documents say
Sombra De Montoya is a single-family residential community in Phoenix, AZ, where lot owners purchase individual freehold estates and the homeowners association maintains shared common areas and enforces strict architectural and design standards. This comprehensive rulebook governs appearance, use, leasing, vehicles, and maintenance—expect close architectural review before any exterior modifications.
- What you own & maintain: You own your individual lot and house. The association maintains landscaped common areas (tracts A, B, C). You are responsible for maintaining the exterior, landscaping, shrubs, trees, grass, and lawn areas on your lot and adjacent right-of-way areas.
- Architectural review: Any exterior modification—paint color, roofing, fencing, alterations—requires written committee approval; applications get a 30-day response window. Approved exterior paint colors are limited to nine specific Dunn-Edwards colors, and two roof tile colors are permitted. Pre-approval may incur a review fee. Unapproved construction carries a $250 penalty.
- Design restrictions: Houses must be minimum 1,100 sq ft, single-story (no split-level or two-story), with roof heights capped at 17 feet. No satellite dishes, antennas, or rooftop air conditioning visible from adjacent properties. Windows facing the street must have permanent white, beige, earth-tone, or pastel coverings within 60 days of purchase. No more than one storage shed per lot (≤7 feet tall) and one swing set, with swings 7+ feet from fences.
- Landscaping & outdoor changes: Front-yard landscaping is initially installed by developer (1×15-gallon tree, 2×5-gallon plants); thereafter owner responsible. Rock must be natural earth tone (no white, green, or red rock). No grading or drainage changes without approval, and violations incur 12% annual interest charges. If landscaping falls into disrepair, association gives 15 days' notice before performing work and charging the owner.
- Parking & vehicles: Trucks, RVs, boats, trailers, campers, and motorcycles are prohibited unless parked in a garage. Standard personal vehicles ≤7 feet tall and ≤18 feet long may be parked on-lot; guest vehicles may park on streets for up to 48 hours. You must provide at least two parking spaces in an enclosed garage. No carports are permitted; garage conversion to living space requires approval. Violating vehicles can be towed at owner's expense.
- Leasing & rentals: Leases must be for at least 30 days (no short-term or vacation rentals), cover the entire lot, be in writing, and specifically reference the project restrictions. A copy must be provided to the association before the lease begins. Transient or hotel-purpose rentals are not allowed.
- Signage & nuisances: One "For Sale" or "For Rent" sign per lot (≤5 sq ft) is allowed; security signs <100 sq inches are permitted. Temporary construction signage (builder, lender, realtor) is allowed for up to 6 months during building. No other commercial, political, or personal signs are permitted. No rubbish, debris, odors, loud noises, clotheslines visible from neighboring property, or outdoor incinerators are allowed.
- Permitted & prohibited uses: Single-family residential use only. Home-based businesses are allowed only if the business is not detectable from outside the home, requires no visitor traffic to the lot, conforms to zoning, and does not create a nuisance or threaten safety. No institutions for the sick or disabled, theaters, bars, restaurants, or commercial operations are permitted. Customary household pets (dogs, cats, birds) are allowed if they don't create a nuisance; the board makes final determination on number and type.
