Sonoran Desert Commons is a condominium community in Phoenix, AZ — you own your individual unit and share ownership of the building's common elements. This is a commercial-use condominium: all units must be used as professional, medical, veterinarian, or business offices. Residential use is not permitted.
- Use restrictions: Units may only be used as professional, medical, veterinarian, or business offices, in compliance with zoning. Any other use requires approvals and may be subject to all unit owner consent after the period of declarant control.
- Pets & animals: No animals, birds, reptiles, fowl, or livestock are allowed in units or on common elements, except fish in aquariums and animals kept by a veterinarian in connection with their practice.
- Leasing & rentals: Leases must be in writing and state that the lease is subject to the declaration and rules. The unit owner must provide the association with lease start/end dates, lessee names, and emergency contact at least 10 days before occupancy. Owners must provide lessees with copies of the declaration and rules.
- Parking & vehicles: Vehicles may only be parked in designated parking spaces; no parking in spaces allocated to another unit unless all of that unit's spaces are in use. No inoperable vehicles, and no mobile homes, trailers, campers, boats, or recreational vehicles may be parked or kept on the premises. Employees must park in allocated spaces or perimeter spaces.
- Antennas & signs: Outdoor antennas, satellite dishes, and other transmission devices require board approval. Signs on building exteriors or visible from outside require board approval, which cannot be unreasonably withheld. The board may set criteria for sign location, size, and appearance.
- Alterations & improvements: Nonstructural interior alterations do not require approval, but any changes to perimeter walls, party walls, or exterior-visible elements require written board approval. Structural alterations require board approval and a certified engineer's statement. The board may impose conditions including security deposits and insurance requirements.
- Maintenance responsibilities: The association maintains and repairs all common elements (including perimeter building walls). Unit owners maintain the interior of their units and certain limited common elements (e.g., chutes, flues, pipes serving only their unit). If a unit owner fails to maintain, the association may step in and charge the owner.
- Assessments: Common expense assessments are levied per unit based on the unit's percentage interest (calculated from square footage). Special assessments, enforcement assessments, and a transfer fee may also apply. The association may place a lien for unpaid assessments.
