This is a First Amendment to the Condominium Declaration for Sunflower Condominiums II, a condominium community in Phoenix, AZ. It updates only two articles of the original declaration: Article 2 (Unit Boundaries, Common Elements, and Fractional Interests) and Article 8 (Insurance). The amendment binds all unit owners and the association. It does not contain the full set of community rules.
- What you own & maintain: Your unit includes the interior finished surfaces of walls, floors, and roof, plus interior partitions, fixtures, appliances, hot water heaters, air conditioning units, and garage (if assigned). Structural components (bearing walls, roof, pipes, ducts) are common elements. Hot water heaters and A/C units are part of the unit.
- Limited common elements: Items like shutters, awnings, doorsteps, stoops, porches, balconies, entryways, driveways, storage areas, patios, exterior doors and windows that serve only one unit are limited common elements—allocated to that unit for exclusive use but owned by the association. Changes to allocation require an amendment.
- Common expense liabilities & votes: Each of the four units has an undivided one-fourth (1/4) interest in the common elements. This fraction also determines common expense liability and voting rights.
- Master insurance by association: The association must carry a master casualty policy covering the common elements and each unit (excluding personal property, tenant improvements, and building service equipment) for 100% replacement cost, with a special condominium endorsement, waiver of subrogation, and standard all-risk coverage. It must also carry public liability/property damage insurance with a minimum $1,000,000 per occurrence, workers' comp, and fidelity bonds covering anyone handling association funds (minimum of 3 months' assessments plus reserve funds).
- Owner's insurance: Owners may obtain additional insurance for their furnishings, personal property, and alterations, but must not diminish or invalidate the association's policies and should include a waiver of subrogation.
- What this document doesn't cover: This amendment does not address leasing/rental restrictions, pet limits, occupancy rules, architectural control, parking, age restrictions, or any other typical HOA rules. Those would be in the original declaration (not provided here).
