This is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for The Reserve at the Pointe Mountainside Golf Community, a single-family HOA in Phoenix, AZ. It governs lot owners in this sub-association, which is part of the larger Moonridge Golf Estates master-planned community with its own Master Association. The CC&Rs outline use restrictions, architectural control, assessments, and maintenance obligations.
- Residential use & home businesses: All residential units must be occupied by a single family as defined (related persons or up to three unrelated persons). Limited home businesses are allowed if not detectable from outside, comply with zoning, and do not generate customer traffic or nuisances.
- Architectural review: Any exterior improvement, alteration, or change (including paint, landscaping, antennas, fences) requires prior written approval from the Architectural Committee. Temporary buildings and construction debris must be removed promptly. Variances may be granted in hardship cases.
- Vehicles & parking: No trucks, trailers, campers, boats, or inoperable vehicles may be parked where visible from neighboring property without approval. Motorcycles and ATVs must be stored in garages. Street parking is limited to 48 hours. The association may tow violating vehicles at owner expense.
- Pets: No more than two dogs, cats, or similar household birds per lot. Pets must be kept on a leash (max 6 feet) when off the owner's lot and must not create noise or nuisance. Structures for animal care must not be visible from neighboring property.
- Assessments & liens: Annual and special assessments are levied against each lot. Nonpayment creates a lien on the lot and may result in suspension of common area use. The association may also charge transfer fees and fines.
- Master Association: This community is subject to a Master Association (Moonridge Golf Estates) with its own governing documents. Owners pay additional assessments to the Master Association. In case of conflict, the more restrictive provision between the Master Declaration and this Declaration applies.
- Golf course risk & access gates: Owners assume all risk of damage from errant golf balls from the adjacent golf course. Card-activated access gates are planned but do not guarantee security.
