The Springs at Yorkshire is a condominium community in Phoenix, AZ, converted from multifamily rental property to for-sale condominium homes. You own your unit and a 1/216 interest in common elements, and the association manages and maintains the common areas and enforces the rules. This document establishes the condominium regime and binding covenants for all owners, residents, and guests.
- What you own & maintain: You own the interior of your unit and a 1/216 undivided interest in the common elements. Each unit also has limited common elements (e.g., designated parking space, patio, mailbox) for exclusive use. The association maintains common elements and may enter your unit or patio for repairs if you fail to maintain them.
- Assessments & fees: Annual assessments are set by the board at a uniform rate per unit; garages are assessed at 10% of the unit rate. Special assessments for capital improvements require 2/3 member vote. Delinquent assessments accrue 18% interest and may become a lien on the unit. A one-time working capital fee (1/6 of annual assessment) is due from each new owner, and a $50 transfer fee is charged on each sale.
- Leasing & rentals: The document does not set a minimum lease term, but the declaration requires that any lease agree in writing that the tenancy is subject to all governing documents. Garages may only be leased together with the associated unit.
- Pets: Dogs, cats, or other household pets may be kept subject to association rules, provided they are not raised or bred for commercial purposes and not in unreasonable numbers. No animals or fowl that become an annoyance or obnoxious are permitted.
- Architectural review: No exterior changes (building, fence, wall, patio cover, awning, antenna, landscaping, etc.) may be made without written approval from the board or architectural committee. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed granted.
- Parking & vehicles: No derelict vehicles, boats, campers, bicycles, or wheeled toys may be left unattended except in garages. Parking is allowed only in assigned spaces or visitor parking. The board may restrict parking and tow vehicles at owner expense.
- Use restrictions: Units are for residential use only; no business, no temporary structures, no signs (except builder sales signs), no loud or nuisance activity, no exterior antennas, and no hardwood flooring above ground floor without sound-dampening subfloor approval.
- Dispute resolution & legal proceedings: Most disputes must go through alternative dispute resolution (negotiation, mediation, arbitration) before litigation. Certain claims (like assessment collection) are exempt. Any association‐initiated lawsuit (beyond routine enforcement) requires a 90% member vote and separate litigation funding.
