What Valencia Groves's governing documents say
Valencia Groves is a single-family residential subdivision in Mesa, Arizona, where you own an individual lot and house. The community is governed by a homeowners association that maintains shared common areas and enforces rules through an architectural committee. Membership is automatic upon ownership, and you'll pay annual assessments plus any special assessments voted on by the membership.
- What you own & maintain: You own your individual lot and detached dwelling unit; the HOA owns and maintains common areas and landscaping at your expense through assessments. You're responsible for maintaining your lot and any damage caused by yourself or your permittees.
- Voting & association control: Every owner automatically becomes a member with one vote per lot (jointly-owned lots count as one member). The developer (Declarant) initially has extra voting power (Class B: 3 votes per lot), but this ends when Class A member votes equal or exceed Class B votes, or 6 years after the first lot sale—whichever comes first.
- Assessments & fees: Annual assessments are uniform across all completed/occupied lots and can increase yearly by the greater of 10% or the Consumer Price Index, without a vote. Increases exceeding 20% require member approval. Special assessments for major repairs or unexpected costs require a 2/3 member vote. Late payments trigger a $15 or 10% fee (whichever is greater) plus 12% annual interest, and the HOA can place a lien on your lot.
- Vehicles & parking: Family vehicles (cars, station wagons, small pickups, motorcycles, SUVs) must be parked in your garage or driveway. Commercial or recreational vehicles (commercial trucks over 1 ton, campers, RVs, boats, etc.) are prohibited except in designated Recreational Vehicle Parking Areas that must be screened from view.
- Architectural review: The Architectural Committee must approve any changes or additions to your lot before construction. The committee has discretion to define what is 'screened from view' and what constitutes various yard areas.
- Land use & restrictions: Your lot is restricted to single-family residential use only—no business operations, no mining or drilling, and no subdivision or time-sharing. Exterior equipment (antennas, satellite dishes, woodpiles, storage areas) is restricted; permitted satellite dishes and DBS antennas must meet FCC standards and size limits.
- Common area access & enforcement: You have non-exclusive rights to use common areas, subject to HOA rules and fees. The HOA can suspend your voting rights and common-area access if you don't pay assessments within 30 days or violate project rules, and can enforce covenants through liens or legal action.
