Valle Venado Units One And Two is a single-family-home planned community in Phoenix, AZ, governed by a homeowners' association (HOA). This Declaration of Covenants, Conditions, Assessments, Charges, Servitudes, Liens, Reservations and Easements establishes the legal framework for the neighborhood, binding all lot owners to pay assessments, maintain their property, and follow common rules. The HOA maintains common areas and provides exterior maintenance for certain lots for an additional fee.
- Assessments & fees: Each lot pays an annual assessment (initially $180/year, paid in $15 monthly installments). Some lots are also subject to a maintenance charge: lots on Exhibit B pay $240/year ($20/month), lots on Exhibit C pay $300.60/year ($25/month). Assessments can increase annually based on the Consumer Price Index or up to 3% without member vote; larger increases require a two-thirds vote of owners.
- Exterior maintenance: For lots subject to the maintenance charge, the HOA paints, repairs roofs and exterior surfaces, and maintains front-yard landscaping originally installed by the builder. It also maintains fences on each lot (except the exterior side of perimeter fences). Owners remain liable for damage caused by their negligence.
- Architectural review: No building, fence, wall, or exterior alteration may be constructed without prior written approval from the HOA Board or an architectural committee. Plans must be submitted and are deemed approved if no decision is made within 30 days.
- Use restrictions & activities: All lots are restricted to residential use only. No business activities are allowed on the property (except during builder's construction and sales period). No temporary structures, trailers, or outbuildings may be used as residences. Clotheslines must be in patio areas; garbage cans and storage piles must be screened from view.
- Pets: Dogs, cats, or other household pets may be kept, but they cannot be raised, bred, or maintained for commercial purposes.
- Signs: Only one 'for rent' or 'for sale' sign per lot, not exceeding five square feet, is allowed. No other advertising signs or billboards are permitted.
- Party walls & easements: Some lots share party walls; repair costs are shared proportionally. Certain lots have easements for access and maintenance by adjacent lot owners. A fence on the easement line is maintained by the dominant lot owner.
- Exempt property: Property owned by Declarant, the HOA, or public/charitable entities is exempt from assessments and maintenance charges until sold to a private owner.
