Villas Montanas is a single-family home HOA in Phoenix, AZ — the rules in this document apply to all lot owners in the community. The declaration establishes a general plan for development, use, and maintenance to protect property values, and includes an affordable housing repurchase right for the first two years.
- Architectural review: Any exterior change (construction, landscaping, paint, etc.) requires prior written approval from the Architectural Committee. The committee has 45 days to respond. The Declarant is exempt from this requirement.
- Residential use only: Lots and residential units are for single-family residential use only. Home businesses are allowed only if not detectable from outside and comply with other conditions; bed-and-breakfast or hotel use is prohibited.
- Leasing & rentals: Leases must be in writing, subject to the declaration, and for a term of at least one year. For the first two years after the declaration was recorded (2006), leasing is prohibited except for hardship situations (death, divorce, job transfer, medical/financial emergency). The owner remains liable for tenant compliance.
- Parking & vehicles: Vehicles must be parked in garages or designated areas. No trucks over 1 ton payload, trailers, boats, RVs, or inoperable vehicles may be parked visible from neighboring property. Temporary parking for events may be allowed by Association Rules.
- Pets & animals: Only reasonable numbers of domestic yard pets are allowed. Pets must be kept in a fenced yard or on a leash, and droppings must be removed. Structures for pets (e.g., dog houses) must not be visible from neighboring property unless approved.
- Affordability & right of first refusal: For two years after the declaration was recorded, the Declarant has a right to purchase a lot at the original sales price before a sale to a third party at a higher price. This is intended to preserve affordable housing.
- Maintenance obligations: Owners must maintain landscaping on their lot and adjacent public/Common Area strips, including paved areas. The Association maintains Common Area and perimeter walls (structural). Owners are responsible for painting the side facing their lot and half of structural repair costs for perimeter walls.
