This is a First Amendment to the Declaration of Homeowner Benefits and Covenants, Conditions and Restrictions for Dobbins Corner, a single-family subdivision in Scottsdale, AZ. It amends only two sections regarding initial working capital payments and transfer fees. The complete set of community rules is in the original Declaration, not this document.
- Initial working capital payment: Each original purchaser of a lot from the Declarant must pay the association a working capital payment equal to one-quarter (1/4) of the annual assessment for the then-current fiscal year. This payment is non-refundable and is collected only upon the original sale, not on resales. It goes into the association's reserve account and cannot be used for the Declarant's expenses or ordinary association expenses during Declarant control.
- Transfer fee: Each owner (except Declarant, original purchasers from Declarant, and certain others) must pay the association a $200 transfer fee upon becoming owner of a lot. This fee covers administrative costs, with any excess going to reserve funds. It is separate from and in addition to regular assessments and the statutory fee for providing a disclosure statement under A.R.S. § 33-1806.
