These covenants run with the land and require that all 5 units on the property be rented to low-income families. The rules bind the property owner (landlord), not residents directly, but residents must meet income and rent limits. This document is the primary rulebook for the property's affordability and non-discrimination requirements.
- Affordability requirements: All 5 units must be rented to families with gross incomes below 50% of the Phoenix area median income, and rents cannot exceed 30% of 50% of the area median income. These requirements follow the HOME Program rules (24 CFR § 92.252).
- Non-discrimination policy: The owner cannot discriminate on the basis of gender, marital status, race, age, disability, color, religion, creed, national origin, or ancestry in the sale, lease, or use of the property.
- Duration of restrictions: The affordability and use restrictions last for the greater of 10 years from the recording of the Certificate of Completion or as long as any amounts are outstanding under the related loan agreement.
