What Diamond Valley's governing documents say
This is a set of protective restrictions (CC&Rs) for Diamond Valley, a subdivision in Prescott Valley, AZ, with residential, commercial, and multi-family lots. The rules apply to lot owners and cover land use, building design, and maintenance. Note that the original minimum 800 sq ft dwelling requirement was removed by a 1966 amendment.
- Use restrictions: Residential lots may only be used for a single-family dwelling or a Water Development Company. No trade or business is permitted, and real estate signs require written approval from Diamond Valley, Incorporated.
- Architectural controls: All buildings and improvements require prior approval of design and location by Diamond Valley, Incorporated or an owners' committee. Exterior materials are restricted: no galvanized metal, asphalt, composition, or plaster board siding; approved materials include stone, masonry, frame, asbestos siding, or building blocks. One single-family dwelling plus one guest house (no kitchen) per lot.
- Setbacks and height: Buildings must be at least 25 feet from the front lot line, 3 feet from the carport side, and 5 feet from the other side. Multi-family buildings may not exceed two stories or 30 feet in height.
- Pets and animals: Livestock and poultry are generally prohibited. Dogs, cats, and other household pets are allowed but cannot be kept for commercial purposes. Poultry raised for personal use is an exception if it does not create a public nuisance.
- Temporary structures and residences: No structure of a temporary character (trailer, tent, shack, garage, barn, etc.) may be used as a residence, either temporarily or permanently.
- Garbage and refuse: No lot may be used as a dumping ground. Trash must be kept in sanitary containers, and outside rubbish burners are prohibited. Owners must haul garbage offsite or use a private pickup service.
- Signs: No advertising signs (including for sale/rent) may be erected without written approval from Diamond Valley, Incorporated. Signs must not endanger health or disturb other lot holders.
- Duration and amendments: These restrictions are binding for 25 years from February 1, 1964, automatically renewing for another 25 years unless 75% of owners agree to changes in writing.
