What Granville Community's governing documents say
Granville Community is a large master-planned community in Prescott Valley, Arizona. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) is the primary governing document for the entire community, binding all owners, lessees, and residents. It establishes the Granville Community Association, defines land use classifications (single-family, condo, apartment, etc.), and sets out the framework for assessments, common areas, design review, and enforcement.
- Community structure & land uses: The community includes various land use classifications: single-family residential, condominium, apartment, cluster residential, and others like community center, park, school, church. Each parcel is further governed by a Tract Declaration that may add specific restrictions.
- Common areas & amenities: Owners have a non-exclusive easement to use common areas, including the Community Center, subject to rules and possible fees. The association can suspend use rights for delinquent assessments or rule violations (up to 60 days per infraction). The golf course land is explicitly not part of the community and grants no use rights.
- Assessments & fees: The association levies annual assessments, special service area assessments, special assessments, and maintenance charges. It can also impose a community enhancement fee on property transfers. Delinquent assessments create a lien and may result in suspension of voting and amenity rights.
- Design review: All improvements and modifications visible from neighboring property must be approved by the Design Review Committee, which follows Design Review Guidelines. The committee's approval is not a guarantee of compliance with other laws.
- Dispute resolution & enforcement: Disputes are resolved through a process described in Article 14, which likely includes arbitration. The association has power to enforce rules, enter property for inspections/repairs, and suspend rights for infractions.
- Golf course: The golf course land is not part of the declaration. Homeowners have no right to use the golf course or any membership in a golf club through their property ownership.
