What Boulder Park Townhomes's governing documents say
Boulder Park Townhomes is a townhome/attached community in Prescott, AZ, where you own your lot and building, but share common areas and party walls with neighbors. The Homeowners Association enforces rules on land use, pet ownership, leasing, and exterior changes. This document is the full Declaration of Covenants, Conditions and Restrictions for the community.
- Permitted use & renting: All lots are for single-family residential use only. Leasing is allowed but must be to a single family, and the owner must provide the Board with the lessee's name, family members, and lease term in advance. No short-term or vacation rentals are explicitly banned; however, the requirement of notice and single-family use suggests no transient rentals.
- Pets: Without the Board's prior written consent, only one dog or cat weighing under 20 pounds is allowed. The Board may set conditions on approval. Owners must clean up after their pets on their own lot and keep animals off common area except when promptly removing waste.
- Architectural review: Any exterior improvement, alteration, or change in color or materials – including fences, antennas, and solar heating – requires prior written approval from the Architectural Committee. The committee has broad discretion over aesthetics and harmony with surroundings.
- Vehicles & parking: No mobile homes, RVs, boats, or trailers may be kept visible from neighboring property for more than 24 consecutive hours (or 48 hours total in 7 days). Only operable cars may be parked in uncovered areas; garages must be used for parking or storage, not living space. Street parking on common area requires Board approval.
- Party walls & fences: Owners of adjoining lots share rights and duties for party walls/fences. Damage caused by one owner must be repaired at that owner's expense; otherwise, costs are shared equally. Disputes go to the Board for binding decision.
- Common area & assessments: The Association maintains the common areas (landscaping, roads, utilities) and levies assessments on all lots. Owners have an easement to use common areas for access, parking, and recreation, subject to Association rules. Nonpayment of assessments can lead to suspension of voting rights and use of common facilities.
