Encanto Real At San Tan Vistas is a standard single-family home subdivision in Queen Creek, AZ, governed by a homeowners association (HOA). The CC&Rs impose detailed residential use restrictions, architectural standards, and mandatory HOA membership for all lot owners. A separate recorded covenant also requires each lot to pay a groundwater replenishment assessment to the Central Arizona Water Conservation District.
- Residential use & home businesses: All lots are restricted to single-family residential use. Commercial businesses are prohibited, but small home businesses are allowed if they do not create traffic, regular clientele, or large delivery trucks.
- Minimum home size & construction standards: Single-story homes must have at least 2,850 square feet of livable floor area (excluding garages, porches, etc.). Two-story homes require at least 1,400 square feet on the ground floor and a total of at least 2,850 square feet. Maximum building height is 28 feet. Mobile homes, manufactured homes, and prefabricated homes are prohibited.
- Setbacks & building envelope: Setbacks are 40 feet from front of any public or private road, 20 feet from side roads, and 40 feet from rear roads. For lots without road easements, the same setbacks apply from deed boundaries. The building envelope may not exceed 50% of the lot area.
- Walls, fencing & landscaping: Front elevation walls must extend from both sides of the house to the lot line and be 6 feet high. Specific wall heights and materials (block or adobe, except view fencing) are required. Three split-rail white vinyl fencing (max 6 feet) is allowed for rear perimeters. Owners must landscape and maintain areas between walls and the street, with plans approved by the ACC. All walls and fencing must be installed before occupancy.
- Architectural control committee (ACC): All construction, alterations, and landscaping must be approved by the ACC. Submissions require plot plans, building plans, and landscaping plans at specified scales. The ACC must approve or reject within 30 days. After 90% of lots are sold, the HOA may elect or disband the ACC.
- Livestock & pets: Horses, sheep, and goats are allowed on lots 1-37, subject to Pinal County guidelines. Combined livestock may not exceed 3 animals. Corrals and pens must be within the back 60 feet of the lot and total no more than 4,000 square feet. Poultry, cattle, and swine are prohibited. Household pets must be reasonable in number and not create a nuisance.
- Vehicles & storage: RVs over 6 feet in height must be hidden behind masonry walls in the backyard and within 100 feet of the house. RVs over 25 feet long cannot be permanently stored. Inoperative or abandoned vehicles must not be visible from other lots. No commercial equipment over 20 feet may be stored. Antennas, satellite dishes (max 18 inches), and other utility equipment must be concealed. Clotheslines, air conditioners, and solar panels must not be visible from ground level of neighboring properties.
- HOA assessments & membership: Each lot owner automatically becomes a member upon closing. An initial assessment of $300 is collected from new owners. Annual assessments are set by the HOA to cover road maintenance, gated entry, landscaping, garbage service, and other common expenses. Unpaid assessments become a lien and may be foreclosed. The HOA also maintains certain entrance walls on designated lots.
