Vallarta Community Association is a standard single-family homeowners association (HOA) in Queen Creek, AZ. These bylaws are the internal rules for how the association operates — they govern board elections, member meetings, and fines. The actual use restrictions (such as pet limits, parking, or leasing rules) are in a separate Declaration, not this document.
- Board of Directors & Voting: The board has 1 to 9 directors, all owners after the transition from developer control. Directors serve staggered 2-year terms. A majority of directors present constitutes a quorum. Owners elect directors at annual meetings.
- Meetings of Members: Annual meetings are held at least once every 12 months. Special meetings can be called by the board or by 1/4 of all voting members. A quorum is 1/10 of all authorized votes. Members can vote in person or by proxy.
- Fines for Rule Violations: The board can impose reasonable fines for violations of the governing documents. The owner gets a Notice of Violation with the fine amount and a description, and must pay within 10 days unless a hearing is requested. The hearing is before the board or a committee.
- Amending the Bylaws: Before the transition to owner control, the developer can amend without a member vote. After transition, amendments require a vote of more than 50% of members present in person or by proxy. Certain amendments also need master association approval.
