What Saddle Creek II's governing documents say
This document is a supplemental declaration for the Saddle Creek II subdivision, registering the community as member land of the Central Arizona Groundwater Replenishment District. It imposes mandatory water replenishment fees and assessments on each parcel, separate from typical HOA rules. This is not the full set of community covenants; it only covers groundwater replenishment obligations.
- Groundwater Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD, based on the Parcel Replenishment Obligation. Nonpayment creates a lien and personal obligation, with interest and penalties.
- Activation Fee: A one-time Activation Fee must be paid by the owner to CAWCD before issuance of a public report authorizing sale or lease of subdivided lands within the property.
- Replenishment Reserve Fee: Category 1 member land parcels must pay a Replenishment Reserve Fee (equal to twice the annual Replenishment Reserve Charge multiplied by projected excess groundwater demand) before the public report is issued. This Article does not apply to Category 2 member land.
- Lien for Nonpayment: The Replenishment Assessment, Activation Fee, and Replenishment Reserve Fee constitute a continuing lien on each parcel, and each owner at the time of delinquency is personally liable.
- Who It Binds: The covenants run with the land and bind the Declarant, all current and future owners, and successors. Amendments require written agreement of CAWCD, the Department, and owners of 67% of total area.
