Adobe Ranch Villas is a townhome community in Scottsdale, AZ — you own your lot and townhouse, but share walls (party walls) with neighbors and share common areas maintained by the Adobe Ranch Villas Homeowners Association. The HOA enforces architectural controls, collects assessments, and maintains common areas and some exterior elements. This document binds all owners, their tenants, and guests.
- What you own & maintain: You own your lot and the interior of your townhouse (including roof, interior fixtures, pipes within your unit, and any fenced yard landscaping). The HOA maintains the common area, front yard landscaping (unless fenced), exterior paint, pool and cabana, and streets/sidewalks. You must not alter the exterior appearance without approval.
- Architectural review: Any exterior change (improvements, alterations, repairs, landscaping, fencing, painting) must be pre-approved by the Architectural Committee (at least 3 members appointed by the Board). No antennas, satellite dishes, or outdoor clotheslines are allowed without approval.
- Assessments & fees: Annual assessments start at a maximum of $780 per lot (1993 figure). The Board can increase assessments each year by the CPI increase. Higher increases require a 2/3 owner vote. Supplemental and special assessments also require 2/3 owner approval. Delinquent assessments bear 6% interest (or FHA/VA rate) and become a lien on the lot.
- Use restrictions: Lots are for single-family residential use only — no businesses, trades, or commercial activity. Animals: only reasonable number of house pets, no nuisance, and no structures visible from neighboring property. No trucks, trailers, boats, campers, or inoperable vehicles may be stored on any street, lot, or common area. No temporary structures or time-sharing allowed.
- Leasing & rentals: The document does not restrict lease terms or require HOA approval for rentals, but owners may delegate their common area use to tenants.
- Party walls: Walls between townhouses are party walls. Repair costs are shared equally between adjoining owners, unless caused by one owner's negligence. Any modification requires written consent from the adjoining owner and the Board. Disputes go to arbitration.
- Signs: No signs except: legal signs, one residential identification sign (80 sq. in. max), and one 'for sale' or 'for rent' sign (5 sq. ft. max) approved in writing by the Architectural Committee.
