Buena Mira is a single-family home HOA in Scottsdale, AZ (10 lots). This Declaration of Covenants, Conditions and Restrictions (CC&Rs) from 1987 binds all lot owners to architectural design standards, use restrictions, and assessments for common facilities. It applies to homeowners, buyers, and renters (via lease delegation of common area use).
- Architectural review & design standards: All exterior improvements need prior written approval from the board or an architectural committee. Approved styles are southwestern, territorial, or Mediterranean (no Tudor, colonial, or modern). Minimum residence size is 3,250 square feet. Roofs must be clay tile or concealed built-up (no shake, metal, concrete, or composition). Siding must be stucco/plaster/hard masonry. Garages must be side-entry and hold at least two full-size cars; carports prohibited.
- Use restrictions: No recreation vehicles (boats, trailers, motor homes) may be stored on a lot unless in an enclosed shelter not visible from streets or neighboring property. No horses or farm animals. No vehicular access directly onto 104th Street. Front yards must be at least 50% Bermuda grass and all visible yards at least 50% green groundcover; landscaping must be completed within 3 months of home completion and maintained. Fences must be built on lot boundaries, cost shared with adjoining owners.
- Single-story & height limits: Lots 5, 6, 9, and 10 are single-story with max roof height 24 feet above finished floor; lofts up to 20% of living area allowed. Lots 7 and 8 are strictly single-story, no lofts, max 24 feet above grade as determined by a formula. Lots 1–4 are subject to Scottsdale zoning height limits.
- Assessments & fees: Each lot owner (except declarant) pays annual assessments, initially capped at $420/year per lot. Annual increases up to 15% without member vote; larger increases or special capital assessments require a 3/5 vote of each membership class. A one-time working capital fee equal to half the current annual assessment is due upon ownership. Assessments are a personal obligation and a lien on the lot, subordinate to first mortgages.
- Common facilities & maintenance: The association maintains perimeter walls (except west boundary), a 10-foot landscape easement along Sweetwater Avenue, right-of-way along 104th Street, and minor entry features. Each lot owner is responsible for maintaining the face of perimeter walls abutting their lot. Owners have an easement to use common facilities and may delegate use to household members, tenants, or contract purchasers.
