This is the full Declaration of Condominium for Monterra Scottsdale Residences, a condominium community in Scottsdale, AZ. You own your individual unit (interior walls, floors, ceilings, and fixtures) plus limited common elements like a balcony and one assigned covered parking space. The association maintains the common elements (building exteriors, common areas, parking lot) and carries master insurance. There are 128 units, each with a 1/128 fractional interest in common elements.
- What you own & maintain: You own the interior finishes and fixtures of your unit, including interior walls, floors, ceilings, doors, windows, appliances, and mechanicals (HVAC, water heater). You must maintain these at your expense. The association maintains all common elements, including building exteriors, structural components, and shared amenities.
- Occupancy & use: Units are for single-family residential use only. A single family is defined as either persons related by blood, marriage, or adoption, or a group of no more than four unrelated adults maintaining a common household.
- Parking & vehicles: Each unit is entitled to one designated covered parking space (a limited common element). All other parking spaces are open and available first-come, first-served. Only 'Permitted Vehicles' may be parked (personal vehicles, including some commercial pickups with restrictions). Recreational vehicles, boats, trailers, and the like are prohibited. Parking spaces cannot be used for storage or leased to non-owners except another unit owner.
- Assessments & finances: Annual assessments fund common expenses and reserves. The board may increase assessments annually by up to the greater of 12% or the CPI change without a membership vote. Any increase above that requires a 75% vote of all members. Special assessments (for capital improvements or unexpected expenses) require a 65% vote. Each new unit owner pays a one-time working capital contribution equal to one-sixth of the then-current annual assessment.
- Architectural review: No structural or exterior changes to your unit, building, or limited common elements (e.g., balcony, exterior doors, windows) are allowed without prior written approval from the Architectural Committee. You may not alter landscaping on limited common elements.
- Insurance: The association must carry commercial general liability insurance (minimum $1M) and all-risk property insurance covering common elements at full replacement cost. Each owner is required to carry their own all-risk casualty insurance on the unit and limited common elements, plus personal liability insurance.
