Verde River is a master-planned single-family residential community in Scottsdale, AZ (formerly Tegavah), governed by an association that maintains common areas, manages a golf course/social club, and enforces architectural standards. Lot owners own their individual homes but pay multiple types of assessments—for common areas, neighborhood-specific facilities, golf club membership, and capital reserves—while the association handles maintenance of shared facilities and design review.
- What you own & maintain: You own your Lot and Dwelling Unit (single-family detached, townhome, cluster home, or zero lot line home); the association maintains Common Areas including trails, landscaping, entry features, lakes, and recreational facilities. Party walls and shared structures in townhomes/cluster homes are governed by Article V.
- Association assessments & fees: Owners pay multiple per-lot assessments: Base Assessment (common area maintenance), Neighborhood Assessment (neighborhood-specific costs), Club Assessment (golf/social club membership), Benefited Assessment (for particular lots), and Additional Assessments (for unanticipated expenses).
- Golf club membership & amenities: Every lot owner is a Club Sub-Member with access to the golf course and social club facilities, funded by Club Assessments. Owners of certain lots listed on Exhibit C are excluded from membership but may opt in by recording a joinder; the Club is governed by a separate Declaration.
- Architectural Review Committee (ARC): All plans and specifications for construction or modification of homes must be submitted to and approved by the ARC before work begins. The ARC enforces Design Guidelines and architectural standards; approval is not a waiver of future requirements.
- Builder (Declarant) control period: The developer (Declarant/Class B Member) retains certain special rights during the Class B Control Period, which expires on the first of: all Maximum Lots conveyed to owners, December 31, 2054, or when the Declarant voluntarily ends it via recorded notice.
- Dispute resolution: Disputes involving alleged construction defects or other covenant violations are subject to binding arbitration (individual basis only; class actions and class arbitrations are prohibited). Article XVI contains the notice and arbitration procedures.
