What Fitzpatrick Ranch's governing documents say
Fitzpatrick Ranch (Sun City West, AZ) is a residential subdivision. This document is a water-related covenant that makes each parcel a member of the Central Arizona Groundwater Replenishment District, binding current and future owners to pay certain fees for groundwater replenishment. It is not a standard HOA rulebook — it only covers water district membership obligations.
- Groundwater replenishment assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD based on the parcel's groundwater use; nonpayment creates a lien and personal obligation.
- Activation fee: An Activation Fee (per housing unit, set by CAWCD) must be paid before the owner can sell or lease subdivided lots in that portion of the property.
- Replenishment reserve fee: For Category 1 member land, a Replenishment Reserve Fee (pro rata share of total projected excess groundwater demand) must be paid before a public report is issued for sale or lease.
- Lien and enforcement: Unpaid Replenishment Assessments, Activation Fees, and Reserve Fees become a continuing lien on the parcel and a personal obligation of the owner at the time the fee was due.
- Amendments: The declaration can only be amended by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total land area, or by changes in applicable statutes.
- What this document doesn't cover: This document does not cover typical HOA rules (pets, parking, architectural review, leasing restrictions, etc.) or any other community living standards. It solely addresses water district membership and associated fees.
