What Viewpoint Lake's governing documents say
This is a set of deed restrictions specific to Viewpoint Lake and adjacent lakefront properties in Sun City Unit Sixteen (Austin, TX area). It applies to owners of single-family or multi-family residential lots adjacent to the lake. The restrictions cover lake use, boat docks, maintenance, and a Board of Management, but do not constitute a full HOA rulebook for the wider community.
- Lake use & boat restrictions: Boats on the lake cannot exceed 14 feet in length or be powered by a motor over 6 horsepower. Boats must be launched only from designated ramps on Tract B. No water may be pumped from the lake for residential irrigation.
- Dock & pier rules: Each single-family lot fronting the lake may have one boat docking facility. Multi-family units may have one dock per unit from common area, not exceeding 10 feet in width. Docks cannot be anchored to the lake bed or side wall (except on Tract B). Docks must not extend more than 10 feet from the crest of the side wall. A fishing pier is allowed on Tract B.
- Lake maintenance & assessments: The Board of Management can levy assessments on lakefront property owners for lake maintenance, including weed removal, cleaning, and replacement of water lost to evaporation and seepage. An initial assessment equal to three times the monthly rate is due at the first sale. Delinquent assessments can result in a lien and loss of lake access.
- Board of Management: A three-member Board of Management oversees the lake. Initially appointed by the developer, after 60% of lakefront units are sold, elections are held: one member from the lake owner, one from the community recreation property owner, and one elected by residential lot owners. The Board has power to make rules, employ workers, and enforce restrictions.
- Architectural review (for docks): All boat docks (except on Tract B) and major modifications must have design plans approved by the Architectural Control Committee. The Committee has 30 days to act; failure to respond constitutes approval. The initial Committee members are named (J.W. Meeker, O.F. Childress, W. Matthews).
- Enforcement & lien: Noncompliance with restrictions gives the Board a lien on the property, enforceable like a realty mortgage. The lien is subordinate to any bona fide institutional mortgage. Violations may be restrained by court action and damages awarded.
- What this document doesn't cover: This document does not address typical HOA matters such as architectural guidelines for houses, landscaping, parking, pets, leasing, age restrictions, or common area amenities beyond the lake. It is limited to the lakefront parcel and its immediate restrictions.
