Kerby Estates is a standard single-family home HOA in Chandler, AZ. You own your lot and house; the association maintains common areas. All owners pay assessments and must follow use restrictions.
- Residential use & home businesses: Lots may only be used for single-family residential purposes. Home businesses are allowed if they are not detectable from outside, comply with zoning, do not involve customer visits or solicitation, and are approved by the Architectural Committee.
- Leasing & rentals: Leases must be in writing, for the entire lot, with a minimum term of 30 days. A copy of the lease must be provided to the Association, and the lease must require tenants to follow the governing documents.
- Pets: Only common household pets (dogs, cats, etc.) are allowed, in reasonable numbers as determined by the Architectural Committee. No commercial breeding. Pets must be kept in a fenced yard or on a leash. No visible pet structures.
- Parking & vehicles: Vehicles must be parked in garages or driveways; on-street parking is limited to short-term guest or loading use. No vehicles over 1 ton, recreational vehicles, boats, or inoperable vehicles visible from neighboring property. No vehicle repairs except emergencies.
- Architectural & exterior changes: All exterior changes (construction, painting, landscaping, etc.) require prior written approval from the Architectural Committee. Approval is deemed given if no response within 45 days after complete application.
- Assessments & fees: Annual assessments are levied per lot. The maximum annual assessment was $960 in 2003, with annual increases tied to CPI or 10% (whichever is greater), but cannot increase more than 20% year-over-year without majority owner approval. Special assessments require a 2/3 vote. A transfer fee is due upon purchase, and the first buyer pays an additional 2 months' assessment into reserves.
- Signs & antennas: Only one temporary for-sale/for-rent sign (max 5 sq ft), one residential identification sign (max 9x30 inches), signs required by law, or signs approved by the Architectural Committee are allowed. Satellite dishes are allowed per FCC rules but must be placed to minimize visibility.
