RRR Farms (Waddell, Arizona) is a planned residential community where owners own individual lots with residential units, subject to HOA-style covenants. This document is amendments to the original Declaration of Covenants, Conditions & Restrictions, covering architectural controls, maintenance obligations, leasing, assessments, and governance rules.
- What you own & maintain: You own your lot and the residential unit on it. You are solely responsible for maintaining the lot, buildings, landscaping, and irrigation systems in good condition and repair. The association may perform maintenance if you neglect it and bill you for all costs, secured by assessment lien.
- Architectural review & approval: Nearly all visible work requires prior written approval from the Architectural Committee: landscaping, vegetation removal, excavation, grading, and any improvement altering appearance. Submit detailed plans with materials, colors, and dimensions. The committee has sole discretion to approve or disapprove (even if plans comply with written standards), and may charge a review fee. Applications are deemed approved if not acted upon within 45 days.
- Mandatory landscaping & appearance: Within 120 days of purchase, you must install landscaping and irrigation on yard areas. Window coverings must be installed within 90 days of occupancy, with exterior colors limited to white, off-white, beige, or natural wood tone. No reflective materials (foil, mirrors, reflective screens) are allowed on windows. Dead vegetation must be promptly replaced.
- Leasing & rentals: You may lease your entire lot and residential unit with a minimum term of six months. Leases must be in writing and state they are subject to all covenants and community rules. At least 10 days before lease commencement, you must notify the association with lease dates, all occupants' names, your contact info, and an emergency contact person. You remain liable for lessee and occupant violations. No subleasing is permitted.
- Pets: Domestic pets are allowed but must not create unreasonable noise or become a nuisance. No pet housing structures may be visible from neighboring property. The board may adopt restrictive rules and can require removal of pets that bite, attack, threaten safety, or cause persistent barking or nuisance.
- Assessments & payment obligations: You must pay regular assessments per the declaration. The association may levy special assessments for common area improvements upon 80% member vote. Delinquent assessments, plus interest and attorney's fees, become a lien on your lot and are a personal obligation of the owner when the assessment became due.
- Voting rights & enforcement: Each lot has one vote in association matters. Voting rights may be suspended if you are more than 15 days delinquent on assessments or don't cure other rule violations within 15 days of notice from the board.
- Boundary walls & shared fences: Fences or walls between adjacent lots are shared by both owners. Both parties pay equally for maintenance, repair, and replacement. If damage results from your negligence or willful act, you bear the full cost. You must obtain written consent from adjoining owners before modifying a boundary wall.
