Chaparral Rancheros is a single-family residential subdivision (Lots 101–443) in Wittmann, AZ. The recorded Declaration of Restrictions sets rules for lot owners and runs with the land. It allows ranch/farm-type use and outlines limits on structures, animals, and parking. A future homeowners association is contemplated to enforce rules and levy assessments.
- Lot use & structures: Lots are residential; only single-family dwellings, guest houses, garages, barns, hobby rooms, or similar structures are allowed. Modular/factory-built homes are permitted if they comply with all rules. Maximum building height is 22 feet; front setback is at least 45 feet, side setbacks at least 30 feet. No lot may be re-subdivided into smaller lots.
- Animals & livestock: Horses, livestock, and usual farm animals are allowed, but swine or pigs are prohibited. No more than 10 total four-legged animals per lot (including dogs and cats), with a limit of 6 horses. All animal facilities must be approved in writing, set back at least 50 feet from the front property line, and located in the rear 75 feet of the lot. Commercial animal husbandry or feed lots are prohibited.
- Architectural review: No structure may be built without written approval from the Architectural Control Committee. Plans must include architectural designs, materials, elevations, and a site plan. The committee has 30 days to approve or reject. Minimum requirements include finished floor elevation 18 inches above grade (unless modified), inside plumbing with septic/sewage, and fly-proof garbage containers. Fences for animal enclosures must be pipe or steel wire; other fences may be metal or wood.
- Parking & storage: No tractors, trucks, farm implements, or machinery may be parked forward of the front building wall. All such equipment must be stored in an enclosed structure at least 100 feet from the front property line and 40 feet from the rear property line. Campers, trailers, boats, and recreational vehicles may not be permanently parked forward of the front building wall. Clotheslines, washing machines, and other appliances must be enclosed or not visible from adjoining properties.
- Homeowners Association & assessments: The company (Chaparral Properties, Inc.) may organize a nonprofit homeowners association (CHAPARRAL RANCHEROS HOMEOWNERS ASSOCIATION) to enforce covenants, maintain common areas, and collect regular or special assessments. Each lot owner will be personally obligated to pay assessments, which will constitute liens on the lot. The association may contract for trash and garbage collection and allocate costs to lot owners.
- Duration & amendments: Covenants run with the land until January 1, 1990, then automatically renew every 10 years. Before 350 lots are sold, the company may amend or modify restrictions unilaterally. After that, any amendment requires agreement between the company and a majority of lot owners. The company may also annex additional property (up to 950 lots) and adjust common area interests accordingly.
