This is a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for Sun City West, an age-restricted (55+) single-family home community in Youngtown/Avondale, Arizona. Owners are members of both the Brookfield Homeowners Association (maintains common areas) and the Recreation Centers of Sun City West (operates recreational facilities, levies homeowner fees). The rules apply to all lot owners and residents.
- Age restriction (55+): Each dwelling unit must be occupied by at least one person 55+; no one 18 or under may reside in any unit. Federal law requires at least 80% of units to be occupied by a household with at least one person 55+.
- Leasing & rentals: Leases must be in writing and subject to all CC&R provisions. No portion of a lot may be rented; only the entire lot with improvements may be leased, and only to a single family. Renters may obtain Rec Center cards (19+ only), but are not association members.
- Pets: Only a reasonable number of common domestic pets are allowed; no livestock, poultry, or commercial breeding. Pets must not create unreasonable noise or nuisance, and pet structures must not be visible from neighboring property.
- Vehicles & parking: No boats, trailers, campers, RVs, mobile homes, or commercial vehicles may be kept on lots or streets except for short-term parking (up to 72 hours/month) for loading/unloading. Vehicles may not be used as living quarters while on the property.
- Antennas & satellite dishes: Ham radio antennas and satellite dishes are expressly prohibited. TV antennas must remain as originally installed in attics.
- Property modifications: No fences other than those originally built by the developer; no chain link or wood fences. No storage buildings, sheds, or greenhouses. Exterior changes require review and approval by the Board of Management or an architectural committee.
- Homeowner fees and assessments: Owners must pay annual homeowner fees to Rec Centers (minimum $106 per year as of 1991, adjustable) and maintenance assessments to the Brookfield HOA. Fees are a lien on the lot and personal obligation; nonpayment may lead to suspension of voting rights and Rec Center access.
